1. Acceptance of Terms
By accessing, browsing, or using Aerio (“the Service,” “we,” “us,” or “our”), including our website and any associated platforms, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service. We reserve the right to update these Terms at any time; continued use of the Service after changes constitutes acceptance of the revised Terms.
2. Eligibility and Account
You must be at least 18 years of age (or the age of majority in your jurisdiction) and have the legal capacity to enter into binding contracts to use the Service. By creating an account, you represent that the information you provide is accurate and that you will keep it current. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized use of your account.
3. Products and Services
Aerio sells digital products and software (“Digital Goods”), including but not limited to licenses, keys, software, and digital access. Product descriptions, pricing, and availability are subject to change without notice. We strive to ensure accuracy but do not warrant that product descriptions or other content are error-free. Delivery of Digital Goods is typically fulfilled electronically (e.g., license key, download link, or account access) as described at the time of purchase.
4. Orders and Payment
By placing an order, you make an offer to purchase the selected product(s) at the stated price. We reserve the right to accept or decline orders for any reason, including suspected fraud, pricing errors, or stock limitations. Payment must be completed via the payment methods we offer. You represent that you are authorized to use the payment method provided and that all information you submit is true and correct. Failure to pay or fraudulent payment may result in order cancellation and account action.
5. Refund Policy
All sales of Digital Goods are final. We do not offer refunds as a matter of course. Due to the nature of digital products—which can be copied, accessed, or used immediately upon delivery—refunds are not available except where we are required by applicable law or where our staff, in their sole discretion, explicitly agrees to a refund in writing.
If you believe you have exceptional circumstances (e.g., duplicate charge, product not delivered as described, or a technical error on our side), you may contact support to request a refund. Any refund is entirely at our discretion. Approval of a refund requires manual review and explicit agreement by our staff. We are under no obligation to grant a refund request. Chargebacks, payment disputes, or reversal of payment without our prior written approval are considered a violation of these Terms and may result in account suspension, ban, and/or further action (see Section 7 – Fraud).
6. License and Use of Digital Goods
Upon valid purchase and payment, we grant you a limited, personal, non-exclusive, non-transferable license to use the Digital Good(s) you purchased in accordance with any product-specific terms or documentation. You may not resell, redistribute, share, sublicense, or otherwise transfer your license or access to any third party unless explicitly permitted by the product or by us in writing. You may not reverse-engineer, decompile, or attempt to extract source code from our products unless expressly allowed by law. We and our licensors retain all rights not expressly granted to you.
7. Fraud and Abuse
We take fraud and abuse seriously. The following are strictly prohibited and may result in immediate account termination, permanent ban, and referral to law enforcement or payment processors where appropriate:
- Chargebacks and payment disputes: Initiating a chargeback, payment reversal, or dispute with your bank or payment provider for a valid purchase—instead of contacting us first for a refund request—is considered fraud. We will contest unjustified chargebacks and may pursue recovery of the disputed amount plus any fees. Your account will be suspended or banned, and you may be blocked from future purchases.
- False or misleading information: Providing false identity, payment details, or other information to obtain products or circumvent our policies is fraud and may be reported to relevant authorities.
- Stolen or unauthorized payment methods: Using payment methods you are not authorized to use (e.g., stolen cards or accounts) is illegal and will be reported.
- Abuse of refund or support systems: Repeated or fraudulent refund requests, false claims about non-delivery, or manipulation of our support or dispute processes may result in a permanent ban and other action.
- Account abuse: Creating multiple accounts to evade bans, abuse promotions, or circumvent purchase limits is prohibited.
We cooperate with payment processors, law enforcement, and other parties to prevent and address fraud. By using the Service, you consent to such cooperation and to our sharing of relevant information where permitted by law.
8. Prohibited Conduct
You may not use the Service to: (a) violate any applicable law or regulation; (b) infringe the intellectual property or other rights of others; (c) distribute malware, spam, or harmful content; (d) attempt to gain unauthorized access to our systems, other accounts, or third-party systems; (e) interfere with or disrupt the Service or other users; or (f) use the Service for any illegal or unauthorized purpose. We may suspend or terminate your access for any violation of these Terms or for any other reason we deem appropriate.
9. Account Termination
We may suspend or terminate your account and access to the Service at any time, with or without notice, for conduct that we believe violates these Terms, harms other users or us, or for any other reason. You may close your account by contacting us. Upon termination, your right to use the Service and any licenses granted for Digital Goods may cease; we are not obligated to provide refunds upon termination except as required by law or as we may agree in writing.
10. Intellectual Property
The Service, including its design, text, graphics, logos, and software, is owned by Aerio or its licensors and is protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works from our content or branding without our prior written permission.
11. Disclaimers
THE SERVICE AND ALL DIGITAL GOODS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF THE SERVICE AND ANY PRODUCTS IS AT YOUR SOLE RISK.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AERIO AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR ANY DIGITAL GOODS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED UNITED STATES DOLLARS (USD $100), WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY; IN SUCH CASES, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
13. Indemnification
You agree to indemnify, defend, and hold harmless Aerio and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your violation of these Terms, your violation of any law or the rights of a third party, or any content or conduct associated with your account.
14. Dispute Resolution and Governing Law
These Terms are governed by the laws of the jurisdiction in which Aerio operates, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the courts of that jurisdiction, and you consent to the personal jurisdiction of such courts. You waive any right to participate in a class action or representative proceeding to the extent permitted by applicable law.
15. Changes to the Service and Terms
We may modify, suspend, or discontinue the Service or any part of it at any time. We may also update these Terms from time to time. We will indicate the “Last updated” date at the top of this page. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.
16. General
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right or provision does not waive that right or provision. These Terms constitute the entire agreement between you and Aerio regarding the Service and supersede any prior agreements. We may assign these Terms or our rights and obligations without your consent.
